GENERAL CONDITIONS OF SALE AND TERMS OF PAYMENT
1. Orders
The customer places his order according to the process valid on the site and confirms its detailed summary.
The customer is obliged to provide all information necessary to the delivery: address, building number, etc…
When placing its first order, the customer must enter his name, first name, E-mail address and create his password.
His password strictly belongs to the user.
The products are offered within the limit of their availability.
Should any ordered produt be unavailable, GK Professional undertakes to inform the customer as soon as possible.
GK Professional cannot be held responsible for the damage caused during the transport of the ordered products.
2. Prices
The prices are likely to be modified without prior notice.
3. Confirmation of order to the customer
GK Professional confirms the order by an e-mail of order confirmation.
However, the customer's order will be deemed accepted only after its validation by the customer service GK Online.
In some cases, GK Professional may require additional information from the customers.
GK Professional reserves the right to cancel an order, if the customer would not confirm his professional information or for non-payment after a 15-day deadline.
4. Cancelation terms - Return of products following a change of opinion
All the articles can be the exchanged within the legal and contractual terms except when otherwise specified.
Pursuant to article L 121-16 of the French Code de la Consommation, the customer benefits from a retractation term of 7 days as of receipt of goods.
If the customer uses this right, the return of the products must be carried out in their packing of origin, in perfect state, accompanied as well as a form of return.
Should products be returned damaged, incomplete or used, GK PROFESSIONAL will reject them.
Return expenses are the responsibility of the customer.
Refunding is due within maximum ninety days after reception of the returned goods.
Refunding can be done either by credit card refund or by cheque, depending on the customer's initial payment mode.
To carry out a return, the customer must first contact the customer service GK Online.
The products must be returned to the address which will be communicated to the customer.
5. Personal information
GK Professional has the right to collect data.
The personal data communicated by the customer or collected via the site operation (by means of cookies or activeX) aim to ensure the good completion of the deliveries, to improve quality of the service and to serve the customers in the best way.
The customer grants the use of these data to GK Professional, in particular to communicate information relating to the services and exceptional offers to him, if he has selected the option to receive newsletters.
GK Professional forbids itself to communicate this data to third parties.
In accordance with the provisions of the Data-processing and Freedoms Law Loi Informatique et Libertés) of January 6,1 978, the customer has a right of access and of correction on the personal data which relate to him by contacting the customer service GK Online.
6. Relation with customers
For questions relating to products and sales, customers can contact GK Online customer servicefor.
For questions relating to the site, it is necessary to contact the webmaster site.
7. Intellectual property
All the elements of GK Professional's website, including subjacent technology, are protected by copyright, trademark or patent rights.
The whole of the graphic charter, the pictures and scenography are the exclusive property of GK Professional
8. Integrality
Should any articles of this agreement become null and void by change of the law, or change of rules or by Court decision, it should not affect under any circumstances the validity and respect of the present general sales conditions.
The present conditions remain valid during GK Professional's website lifetime . They can be modified without notice by GK Professional.
9. Competent law
The present conditions are subject to the French law.
Litigations rising from the application of these general conditions of sales are subjecte to the French law and only the French courts can handle these litigations. Litigations between GK Professional and any professionals are subject to Paris Court in all cases
10. Evidence
In all cases, order is entirely completed after transmission of credit card number online. The final validation of the order constitutes the evidence of the integrality of said order in compliance with the provisions of the law of March 13, 2000 and, consequently, immediately generates the obligation to pay for the products selected in the order.
This validation is worth signature and express acceptance of all the operations carried out on the site.
The computerized registers, saved in the information processing systems of GK Professional under reasonable conditions of safety, will be regarded as evidence of the communications, orders and payments occurred between the parties.
The filing of the purchase orders, the confirmations of order and the invoices is carried out on a reliable and durable support so as to correspond to a faithful and durable copy in accordance with article 1348 of the Civil code.
